Terms of Service

1. Acceptance of Terms
By accessing or using LatinaCastings.com ("the Site"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Site.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to access this Site. By using this Site, you represent and warrant that you meet this requirement. Signing in to an account is your confirmation that you meet this requirement, and we treat every signed-in member as an adult.
3. Age Verification
Access to explicit content requires a one-time, account-level age verification, enforced server-side. In most regions, confirming from your account that you are at least 18 is sufficient. In jurisdictions with viewer age-verification laws (including certain U.S. states and the United Kingdom), stronger proof is required and self-attestation is not accepted. An account that has not completed verification can browse non-explicit surfaces but cannot view or generate explicit content. Purchasing credit does not unlock explicit content and is not a substitute for verification.
Where you are matters as well as who you are. In the United Kingdom we do not serve the site at all. In US states with viewer age-verification laws we show only performer headshots and content we have marked as non-explicit, whether or not you have an account and whether or not you have verified. This does not apply to chat with a signed-in member, described below. What we do, where we do it, and what we would accept as proof is set out in full on our How we check age page.
Chat is the one exception to the verification described above. A signed-in member can have explicit text conversations with the characters without completing age verification, because signing in is your confirmation that you are an adult (see section 2). Visitors who are not signed in get a non-explicit chat.
4. Account Registration
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Credits & Payments
All content and features on LatinaCastings are accessed using a USD credit balance on a pay-per-use basis. We do not process credit cards. Your credit does not expire. Credit costs vary by action (for example, creating a model, training it, or generating photos and clips).
Delivery. Everything you buy on LatinaCastings is digital and is delivered on the Site. Nothing is shipped. Photos are made while you wait. Training, photoshoots and clips run on our servers after you order them: training takes about 75 minutes, and we email you when a model or a photoshoot is ready. What you make is saved to your character and stays unpublished until you choose to publish it. If work you paid for fails on our side, or a photoshoot delivers fewer photos than you ordered, the price of what was not delivered is returned to your credit balance automatically.
6. Content Usage
All content on this Site is owned by LatinaCastings or its licensors. You may not reproduce, distribute, modify, or create derivative works from any content without explicit written permission.
7. AI-Generated Content
All performer imagery and video on this Site is computer-generated. The performers are fictional virtual characters; no real people are depicted, and content is not presented as depicting any real person. Content generated with the Site's tools at your direction may be viewed and used within the Site under your account; the underlying models, software, prompt libraries, and site content remain the property of LatinaCastings or its licensors.
8. Prohibited Conduct
You agree not to: share account credentials, attempt to circumvent access controls, scrape or download content, harass other users, or use the Site for any unlawful purpose.
You also agree not to use the Site to create, request or share, in images, clips or chat: deepfakes or any image or likeness of a real person; anyone under 18 or anyone presented as a minor; non-consensual scenarios, including anyone asleep, unconscious, drugged, intoxicated or hypnotized; incest; urination or other watersports scenarios; violence, abduction or snuff; bestiality or animal cruelty; prostitution or escorting; polygamy; instructions for illegal activity; medical, legal, financial or gambling advice; or hate speech. We remove content that breaks this rule and may suspend or close the account.
9. Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users or the Site.
10. Limitation of Liability
The Site is provided "as is" without warranties of any kind. In no event shall LatinaCastings be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the updated Terms.

13. Refunds, Cancellation and Disputes
Card payments are not available during the private beta (see section 5). This section states the terms that govern credit refunds. It applies to credit added to your account by our team today, and to purchased credit when card payments begin.
Purchased credit you have not spent. If you buy credit and change your mind, you can ask for a refund of the part you have not spent. Ask within 14 days of adding it, through the contact form or by email to support@latinacastings.com. We refund the unused amount to the card you paid with.
Team-added credit. Credit added to your account by our team, for example a courtesy or beta grant, has no cash value and is not refunded.
Spent credit. Credit already spent on a completed generation or a completed chat message is not refunded. The price was shown to you before you committed, and the compute behind it was used the moment you did.
The one automatic exception. If a generation you paid for fails on our side, the price is returned to your balance automatically. You do not need to ask. The refund appears as its own line on your credit statement on the Credit page.
Prepaid only. Your credit balance is prepaid. Every paid action takes its price from your balance before the work starts, and an action your balance cannot cover does not start. We never bill you after the fact, and nothing renews or charges automatically.
What a refund or chargeback does to your balance. If a card payment is refunded, or reversed by your card issuer (a chargeback), we remove the amount of that payment from your credit balance. If your balance is lower than that amount because the credit was already spent, your balance goes to zero and we absorb the difference. Your balance never goes below zero, and we never bill you or collect the difference from you. When a chargeback is opened on your account, we suspend the account until we have reviewed it. If the chargeback was for credit you had already spent, we may close the account under section 9.
Chargebacks. If you have paid by card, please contact support before opening a dispute with your card issuer. Most billing questions are settled the same day, and a dispute freezes the charge for weeks. We answer at support@latinacastings.com. The 14 days above are the window for asking us for a refund. They do not limit your right to dispute a charge with your card issuer, and we do not refuse a dispute because of them. If a chargeback is filed on a charge you asked us about, we will send the issuer our record of the charge, the balance it created, and how it was spent.
Closing your account. There is no subscription to cancel. You can deactivate your account at any time from Account settings. Deactivating disables sign-in; it does not delete your data or your published models, and support can reactivate the account on request. If you have unused purchased credit when you close your account, we refund it on request, if you ask within 14 days of adding that credit. To have your data deleted, email support@latinacastings.com.

14. Third-Party Model Terms
Some images on LatinaCastings, including the images used to train your characters, are made with open-source models licensed under the CreativeML Open RAIL++-M License. That license requires everyone who uses those models through the Site to follow its use restrictions, so they are part of these Terms. You agree not to use the Site, its models, or anything they create:
- in any way that violates any applicable national, federal, state, local, or international law or regulation;
- to exploit, harm, or attempt to exploit or harm minors in any way;
- to create or share verifiably false information or content meant to harm others;
- to create or share personal information that can be used to harm a person;
- to defame, disparage, or otherwise harass others;
- for fully automated decisions that harm a person's legal rights or create or change a binding, enforceable obligation;
- in any way meant to, or that has the effect of, discriminating against or harming people or groups based on their online or offline social behavior or their known or predicted personal or personality characteristics;
- to exploit the vulnerabilities of a group of people based on their age or their social, physical, or mental characteristics in a way that causes, or is likely to cause, physical or psychological harm to them or to someone else;
- in any way meant to, or that has the effect of, discriminating against people or groups based on legally protected characteristics or categories;
- to provide medical advice or interpret medical results; or
- to create or share information for use in the administration of justice, law enforcement, immigration, or asylum processes, such as predicting that a person will commit fraud or a crime.
These restrictions apply in addition to section 8. If you break them, we may suspend or terminate your account under section 9.
